IEPA Regulates Uncontaminated Soil Used as Fill

The Illinois General Assembly recently passed an Act that affects the disposal of uncontaminated soil at old quarries, mines, and other excavations. These are known as Clean Construction or Demolition Debris (CCDD) and uncontaminated soil fill operations facilities that are permitted by IEPA to fill their pits with clean construction debris and uncontaminated soil. Most, in reality, will only accept clean soil with no debris.
 
Effective July 30, 2010, new requirements and forms have been put into place before soil can be accepted. Soil coming from commercial or industrial sites must be certified to be “Uncontaminated” by a Professional Engineer (P.E.). The IEPA requires the P.E. to compare soil samples to the most stringent requirements identified in their list of carcinogens and chemicals listed in Title 35 IAC part 742 Tiered approach to corrective action objective that threaten human health and the environment. Therefore, comprehensive testing is required to validate the soil to be removed is Uncontaminated.
